What qualifies for prior express written consent?

It must be a clear, written agreement (can be electronic) That states the consumer agrees to receive calls or texts, and includes the number being called.

How does Callpliance get written consent over the phone?

Callverify.me integrates with any dialer or CRM. . After verbal permission is given by the consumer, the company representative checks the callverify.me disclosure box inside the dialer or crm, and a company branded link is sent to the consumer's mobile device using a dedicated 10DLC. This link allows the consumer to verify their contact information and consent to future outreach.

Does Callplaince supply the TCPA language for the express written consent?

No. The callverify.me form displays the TCPA language that is uploaded into your account. This is a dynamic input, which allows your company to have their callverify.me forms up to legal standards at all times.

How do I have proof that the person on the phone completed the form?

Once consent is given, the agent will be notified inside the dialer or crm, and a playback will be sent to your Callpliance dashboard. This playback shows a full breakdown of the interaction from when the call started, when the consumer clicked on the form and electronically consented. Each consent is given a unique token that can be easily located inside your dashboard.

If someone is on my internal DNC and calls back into my business, does this still give me consent to call them back?

Yes, if a consumer calls in and consents to be contacted via your banded page, this would be considered re-consent and would override the previous request.

Is using an auto-dialer without consent ever allowed?

Only for non-commercial calls like political campaigns, emergency, purely informational messages, that do not involve any sales or marketing.

Can I call someone back that called me without consent?

As long as you are not using an auto dialer, yes you can call back someone that initiated the contact voluntarily. If your return call involves automated technology, then you would need express written consent to call them back.
